How Is Community Property Divided Between Spouses In A Divorce?


The judge divides community property and liabilities in a “just and right” manner that may result in the judge awarding more community property to one spouse. In making the division, the judge can consider any relevant factor, which might include evidence of:
 

  1. Fault in the break-up of the marriage
  2. Differences in earning capacities and education
  3. Age and health of the parties
  4. Any special needs of the parties
  5. Separate property or potential for inheritance of either spouse
